The NEC 3 in general terms

• The second edition of the ECC and subsequently NEC 3 aims to comply with all 13 principles listed in Sir Michael Latham’s report Constructing the Team as essential characteristics for a modern form of contact:

• Effective Management is an integral part of this philosophy

• The contract is elevated to the position of the primary source of information for determining the cost of change

• It places great emphasis on the Contractor maintaining an up to date programme throughout the construction period

• This is an important document for administering the contract

• It enables the Project Manager and Contractor to monitor progress and to assess the time effects of compensation events.

• The Importance of the Project Team

• Items of change, potential change and risk must be highlighted immediately.

• This will allow appropriate early warning notices etc. to be issued, and will enable dialogue to commence at the earliest opportunity so as to resolve the issue swiftly and to the satisfaction of all parties.

In NEC The Programme Matters

• The considerable list of requirements remains (but is re-arranged)

• Is however very brief when compared to other contracts regarding:

• Treatment of time related matters

• Important matters of sectional completion and delay damages dealt with in the secondary options

Conveys an impression that time related matters under New engineering contract 3 are matters of simplicity)“Unfortunately this is something of an illusion. Ten years of usage of ECC 2 before its replacement by NEC3 showed that the types of disputes on time related matters which plague traditional construction contracts are no less frequent under this Contract,however turning to the contract is not much help in resolving such disputes. • It is therefore vital to ensure our house is kept in order and that:

• The documentation is developed and implemented as part of an ongoing change and performance management system for the project
